Terms of Service

1. About SomaScope

SomaScope is a mobile application developed and operated by MankaSoft Michał Mańka (ul. Kościuszki 48, 43-100 Tychy, Poland; NIP: 6463024833). The App analyzes body proportions, tracks physical progress, and personalizes training experiences using on-device processing where supported by the app version and the user's device.

2. Eligibility and Age Classification

The final SomaScope age rating may depend on app version, distribution country, and app-store rules. Information displayed in the app store takes precedence over this general website description.

For the purposes of registration and independent cloud data management, you must be at least 13 years old (or 16 years old if you reside in the EU). By using the App, you confirm that you meet these requirements or have obtained prior parental or guardian consent.

3. ⚠️ Medical & Sports Disclaimer

Before starting any new training program, significantly changing your diet, or if you have any pre-existing health conditions, injuries, or concerns — consult a qualified medical doctor, physiotherapist, or certified personal trainer.

The Service Provider (MankaSoft) expressly disclaims any liability for health, fitness, or lifestyle decisions made by users on the basis of information provided by the App.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify me immediately at m.manka@mankasoft.com of any unauthorized use of your account.

MankaSoft reserves the right to suspend or terminate accounts that violate these Terms, are used for fraudulent purposes, or engage in behavior that disrupts the service for other users.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulations.
• Attempt to reverse-engineer, decompile, or extract the source code or AI model weights from the App.
• Upload content that is obscene, defamatory, or infringes the rights of third parties.
• Use the App to generate, store, or transmit malware or malicious content.
• Attempt to gain unauthorized access to servers or any connected systems.

6. Purchases & Subscriptions

If a given SomaScope version offers premium features, they may be available through a subscription or one-time in-app purchase. Purchases are then processed by Apple App Store or Google Play Store — MankaSoft does not handle payment card data directly.

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Refunds are governed by the respective store's refund policy (Apple or Google). MankaSoft does not process refunds directly.
• Free trial (if offered): unused portions of a free trial are forfeited upon purchase of a subscription.
• "Lifetime" purchase — the one-time "Lifetime" purchase grants access to premium features for as long as the SomaScope App is offered and actively maintained by MankaSoft ("lifetime of the App"). It does not refer to the lifetime of the user and does not guarantee perpetual availability of the App.

MankaSoft reserves the right to modify, suspend, or permanently discontinue the App or any of its features. In the case of permanent discontinuation, we will make reasonable efforts to provide advance notice. Your statutory rights under mandatory consumer protection law remain unaffected.

7. Intellectual Property

All rights to SomaScope — including but not limited to its source code, on-device AI models, graphic design, UI/UX, logo, name, and all associated branding — are the exclusive property of MankaSoft Michał Mańka and are protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes, subject to these Terms.

8. Third-Party Services

Depending on app version and enabled features, the App may integrate with the following third-party services:

• Google Firebase — for authentication, data synchronization, and crash reporting (governed by Firebase Terms of Service).
• Google Sign-In / Apple Sign-In — for account authentication.
• Apple App Store / Google Play Store — for app distribution and payment processing.

MankaSoft is not responsible for the practices or content of these third-party services. Their use is subject to their respective terms and privacy policies.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MankaSoft provides the App on an "as is" and "as available" basis, without warranties of any kind — express, implied, or statutory — including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

MankaSoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App, including but not limited to loss of data, personal injury, or health-related outcomes.

10. Changes to These Terms

MankaSoft reserves the right to modify these Terms at any time. When we do, we will update the \"Last Updated\" date above. For significant changes, we will provide a prominent notice within the App or via email. Your continued use of the App after the effective date of any changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Tychy, Poland, unless otherwise required by mandatory consumer protection law in your country of residence.
